Illinois Medical Negligence Attorneys Represent Birth Injury Claim - Power, Rogers & Smith

Chicago, IL (PRWEB) January 24, 2007 -- On November 17, 2006, Associate Judge Elizabeth Budzinski of the Circuit Court of Cook County, Illinois, Law Division, approved the $9,500,000 settlement of a medical negligence case -- a birth injury claim, case #03 L 11700, filed by Tanisha Grant as Mother and Next Friend of Da'Janae Baker against West Suburban Hospital Medical Center, John C. Holanday, R.N., Beth Lopez, M.D., Mark P. Macumber, M.D., Gina Laraine Smith, M.D., for injuries sustained during the labor and delivery of Da'Janae Baker on October 24, 2001. Tanisha Grant was represented by Larry R. Rogers, Sr., of Power Rogers and Smith.

Through the personal injury investigation, it was discovered that on October 22, 2001, Tanisha Grant went to PCC Wellness Center at West Suburban Clinic for a regular prenatal checkup. Tanisha was admitted to the hospital and medical personnel attached a fetal monitor to her and started induction of labor with Pitocin on October 22, 2001 because she was eclamptic.

Tanisha began dilating in the early hours of October 23, 2001 and had an epidural administered. Tanisha was fully dilated at approximately 10 p.m. on that same day and began pushing, but after hours of inadequate progress of labor a C-section was done at 2:51 a.m. on October 24, 2001. During labor, episodes of hyperstimulation of the uterus occurred as well as decelerations of fetal heart tones. The fetal monitor also malfunctioned and failed to accurately record contractions. During Tanisha's labor, her fetal heart rate monitor tracings revealed signs of and were consistent with fetal stress and/or distress. According to the case, Drs. Lopez, Smith, Tarpey, and Macumber failed to recognize the significance of changes in the fetal heart rate as evidenced on the fetal monitor strips from October 23rd through October 24th, 2001. During that time, Da'Janae's fetal heart rate was increasing in rate from baseline.

Da'Janae was delivered by emergency caesarean section on October 24, 2001. Upon birth, Da'Janae was not breathing and depressed and shortly after birth, she was transferred to Children's Memorial Hospital where she was diagnosed with severe cerebral palsy, spastic quadriplegia, and seizure disorder.

This birth injury claim case remains pending against Dr. Michael Tarpey and Cook County Hospital.
