Swarmify Files Lawsuit against Cloudflare Alleging Misappropriation of Trade Secrets and Breach of Contract
SAN FRANCISCO (PRWEB) December 07, 2017 -- Swarmify, Inc. has filed a lawsuit against Cloudflare, Inc. alleging misappropriation of trade secrets, breach of contract, and six other claims with the United States District Court in the Northern District of California (CASE NO. 3:17-cv-06957). The lawsuit was filed by Skiermont Derby LLP who is representing Swarmify in this matter.
In 2013, Swarmify was founded to solve the persistent problems of video buffering and streaming failures. Court documents allege a new streaming product, Cloudflare Stream, contains trade secrets, intellectual property, and proprietary techniques disclosed under NDA to Cloudflare during the course of acquisition and partnership discussions in 2016 and 2017.
CEO and Co-Founder of Swarmify, Nathan Barnett, says his team developed the video acceleration solution to offer audiences an 80 percent reduction in buffering and instant load speed. Following the launch of Cloudflare’s streaming solution on Sept. 27 of this year, Swarmify retained Skiermont Derby LLP, a boutique firm representing plaintiffs in high stakes intellectual property disputes. The court filing alleges that Cloudflare disclosed proprietary techniques on the Cloudflare blog as well as implementing these techniques in the Cloudflare Stream product. The lawsuit also requests a preliminary and permanent injunction to prevent continued use of Swarmify Technology and Confidential Information by Cloudflare.
