Mirena Lawsuits Mount in New Jersey Litigation, as Number of Cases Filed Exceeds 960, Bernstein Liebhard LLP reports

According to a new Case List issued in the litigation on August 4th, at least 960 cases have been filed in Bergen County. The new number indicates that more than 40 Mirena IUD lawsuits were added in the litigation since the previous Case List was released in July, when 928 filings were noted.

According to court documents, all of the complaints pending in New Jersey claim that Bayer Healthcare Pharmaceuticals failed to adequately warn that the IUD could spontaneously migrate from its proper position in the uterus, even after it had been correctly inserted by a healthcare provider. Plaintiffs in Mirena lawsuits further allege that this occurrence caused a variety of serious injuries, including uterine perforations, organ damage, scarring, and infertility. Among other things, the claims point out that the labeling for the birth control device only warns that migration might occur if the uterus is punctured during its insertion.
Court records indicate that in addition to the claims pending in New Jersey, an additional 612 Mirena lawsuits involving similar allegations have been filed in a federal multicounty litigation now underway in U.S. District Court, Southern District of New York. The Mirena IUD is a long-acting contraceptive device that was first approved by the U.S. Food & Drug Administration (FDA) in 2000. It is inserted directly into the uterus by a healthcare provider, where it releases a synthetic progesterone for up to five years. In 2009, its approved uses were expanded to include the treatment of heavy menstrual bleeding in women who wish to use an IUD for birth control. In December 2009, the FDA also issued a warning letter to Bayer Healthcare Pharmaceuticals after finding that one of its Mirena promotions overstated the IUD’s benefits and downplayed its risks.
