Kadmos Consultants give tips on the Genuine Entrepreneur Test for Tier 1 Entrepreneur migrants

Tier 1 Entrepreneur route is part of the UK Points Based System. It is designed to attract business minded individuals who have intention and capacity to open or take over a business in the UK. The applicant has to demonstrate availability of £200,000 capital for investment into the proposed business. Concessionary capital requirements of £50,000 applies to government funded ventures, Graduate Entrepreneurs and Post Study Work migrants who run or intend to run a business offering services at NQF level 4 or above.
The application can be made from within the UK by holders of Tier 1 and Tier 2 visa. Other applicants have to apply for entry clearance from their country of origin or habitual residence.
The applications can be made by entrepreneurial teams of two participants and third party funding is permissible as long as the immigration authorities can be satisfied in reliability of the source.
Tier 1 Entrepreneur visa leads to settlement or indefinite leave to remain after five years, or after three years for particularly successful businessmen.
The requirement to demonstrate “genuine intention and ability” to run a business was added to the Immigration Rules in January 2013 (1). This requirement is not part of the points scoring exercise but failure to satisfy this test leads to a visa refusal.
The rules do not spell out which documents are required as evidence of genuine intention which potentially makes it more difficult for the applicants to address the issue. Immigration authorities may invite the applicant for an interview in order to ascertain availability of the capital post the date of the application and assess the intention and ability of the applicant to manage a business.
