ASA College Announces the Dismissal of NYLAG Lawsuit
NEW YORK, NY (PRWEB) June 22, 2015 -- On Friday, June 5, 2015, the US District Court of the Southern District of New York dismissed the lawsuit Sanchez v. ASA College Inc., case number 14-CV-5006, brought by the New York Legal Assistance Group (NYLAG) together with Emery Celli Brinckerhoff & Abady LLP (ECBA) on behalf of eight former students against ASA College of New York City.
ASA College, Inc. offers certificates and associates degrees in career-oriented fields. In their putative class suit, plaintiffs, former ASA student, claimed victimization by ASA’s alleged systematic, fraudulent misrepresentations as to the nature of its programs as part of a massive scheme to induce student enrollment so as to draw federal and state financial aid to ASA. Plaintiffs claimed ASA’s actions violated RICO and New York General Business Law §349. Dismissing suit the court concluded that plaintiffs did not adequately plead their RICO claims, especially those predicated on alleged acts of mail and wire fraud by ASA’s defendant officers. Plaintiffs’ complaint failed to prove that the various individual defendants possessed the requisite fraudulent intent, and their claims against those defendants handling ASA’s job placement activities fell short of the particularity requirements of the Federal Rule of Civil Procedure 9(b). Among other things, plaintiffs' civil RICO conspiracy claims were found to be conclusory. The court declined to exercise supplemental jurisdiction over plaintiffs’ state law-based claims.
