The jury found that AMC was negligent in the management of its property and also found comparative fault on the part of the plaintiff, holding AMC was 75% responsible. In October 2016, the plaintiff and his wife went to their local AMC theater to enjoy a matinee showing of "The Accountant." It was raining outside, so AMC relocated ticket sales inside, setting up stanchions to guide customers and prevent ticket evasion. The path created by the stanchions led customers over a slick terrazzo floor that became wet as customers came in out of the rain. While AMC put out two mats, it left a large gap between them, which is where the plaintiff slipped and fell, causing serious neck and shoulder injuries.
AMC denied the plaintiff slipped, that it was negligent and that the plaintiff was seriously injured by the fall. "AMC essentially made its customers transit an unfinished bridge exposing them to a floor that was dangerously slippery when wet and they failed to take multiple, easy, cheap steps to prevent this serious incident," said Mr. Pardon, co-lead trial counsel for the plaintiff. Mr. Pardon went on to say that AMC refused to take any responsibility for the incident and expressed praise for the jurors being able to see through AMC's tactics.
