Following a jury trial that concluded on May 24, 2022, workers' compensation insurance broker AP Keenan has been found guilty of conspiring to discriminate against a disabled worker. The jury awarded $34,508,000 in damages.
SANTA CRUZ, Calif., May 31, 2022 /PRNewswire-PRWeb/ -- Following a jury trial that concluded on May 24, 2022 in Santa Cruz Superior Court Case No. 19CV00488, the Plaintiff alleged that he was wrongfully terminated from his employment with Defendant Santa Cruz City Schools (hereafter the "District").
A jury trial proceeded against the District's workers' compensation insurance administrator and Co-Defendant, AP Keenan. AP Keenan, formerly known as Keenan & Associates, is a division of Assured Partners, Inc., the eleventh largest insurance broker in the United States and a company with more than $1.6 billion in annual revenues according to its own website.[[1]]
Plaintiff alleged that AP Keenan repeatedly misrepresented his work restrictions to the District, and also that AP Keenan altered certain medical reports before providing them to the District.
On May 23, 2022, the jury returned a liability verdict, finding that AP Keenan had conspired with the District to violate California's Fair Employment and Housing Act ("FEHA"). The jury also found that AP Keenan aided, abetted, incited, coerced, or compelled the District to violate the FEHA, and/or attempted to do so. The jury awarded $6,908,000 in compensatory damages.
Because the jury also found that AP Keenan acted with "malice, oppression, or fraud," a punitive damages phase of trial commenced the very next day. On May 24, 2022, the jury returned a punitive damages verdict in the amount of $27,600,000, bringing the total damages awarded against AP Keenan to $34,508,000.
