The complaint alleges employees were from time to time unable to take thirty (30) minute off-duty meal breaks or were not fully relieved of duty for their meal periods. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work.
Additionally, Blue Link Wireless, LLC allegedly failed to pay employees for all the time they were under the employer's control. This, allegedly, includes the time Plaintiff and other California Class Members had to submit to mandatory COVID-19 screening prior to clocking in for the day. To the extent that the time worked off the clock did not qualify for overtime premium payment, Defendant allegedly failed to pay minimum and overtime wages for the time worked off-the-clock.
