Point Pick-Up Technologies, Inc. allegedly violated the California Labor Code by failing to properly classify employees as non-exempt, which contributed to incorrect wages.
SONOMA, Calif., June 8, 2022 /PRNewswire-PRWeb/ -- The San Francisco employment law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP filed a class action complaint alleging that Point Pick-Up Technologies, Inc. violated the California Labor Code. The Point Pick-Up Technologies, Inc. class action lawsuit, Case No. SCV-270882, is currently pending in the Sonoma County Superior Court of the State of California. A copy of the Complaint can be read here.
The lawsuit filed against Point Pick-Up Technologies alleges Plaintiff and other California Class Members should have been properly classified as non-exempt employees entitled to overtime compensation. Allegedly, DEFENDANT misclassified employees as "independent contractors." As a result of this, employees allegedly were paying Defendant's share of payroll taxes and mandatory insurance premiums, in addition to missing out on overtime wages.
Additionally, Point Pick-Up Technologies, Inc. allegedly failed to fully relieve Plaintiff and other California Class Members for their legally required thirty (30) minute meal breaks. Employees were also allegedly required, from time to time, to work in excess of four (4) hours without being provided the legally required ten (10) minute rest periods. The California Supreme Court defines off-duty rest periods as time during which an employee is relieved from all work related duties and free from employer control.
