“We continue to hear from women who have had to undergo surgical removal of Mirena caused by complications that allegedly resulted from spontaneous migration of the IUD. We are pleased to see these lawsuits moving forward,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free Mirena lawsuit consultations to young women who allegedly suffered uterine perforations, device migration and other serious Mirena side effects.
Mirena IUD Lawsuits
According to court documents, more than 180 Mirena lawsuits are currently pending in the New Jersey litigation. Over 100 additional claims have also been consolidated in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434) All of the lawsuits allege the Mirena IUD migrated away from its original position in the uterus, leading to uterine perforations, damage to other organs, infections, scarring, and ectopic pregnancy. Plaintiffs further allege that Bayer Healthcare Pharmaceuticals failed to provide patients and doctors with adequate warnings regarding the Mirena IUD’s potential to spontaneously migrate and perforate the uterus.
The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a contraceptive in 2000. It has since been approved to treat heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. According to recent media reports, the FDA has received more than 70,000 complaints involving Mirena complications since the IUD was first brought to market.*In 2009, an FDA Warning Letter criticized Bayer Healthcare Pharmaceuticals for making what the agency considered to be misleading claims about the purported benefits of the IUD and the potential for serious Mirena side effects.
Women who may have been harmed by Mirena could be entitled to compensation for their medical bills, lost wages, pain and suffering and other damages.
