With a child molestation conviction in his past, Darryl M. was in danger of being permanently committed by the State of California as a sexually violent predator. California Mental Health Defense Attorney Ken Rosenfeld of The Rosenfeld Law Firm argued that his client had received sufficient mental health treatment in the 30-year interim since his offense to be deemed unlikely to recommit his crime. The petition requesting Darryl M. to be committed to a state hospital for life was subsequently dismissed, and he was able to go home.
SACRAMENTO, Calif., April 11, 2023 /PRNewswire-PRWeb/ -- The Rosenfeld Law Firm announces that a mental health client facing the possibility of a lifetime commitment as a sexually violent predator (Case# 07F11055) has had the petition against him dismissed as the result of the efforts of California Mental Health Attorney Ken Rosenfeld.
According to the Sexually Violent Predator (SVP) petition filed with the Sacramento County Superior Court, Darryl M., due to the fact that he previously had been convicted of a sexually violent offense as defined by California's Welfare Institutions Code (WIC) § 6600—to wit, child molestation (PC § 647.6)—and due also to the fact that D.M. has been diagnosed with a mental disorder that could potentially lead him to become a repeat offender, the State of California sought lifetime commitment of D.M. as a sexually violent predator rather than be released after completing his prison term. Rosenfeld made the argument that his client had received sufficient mental health and sex offender treatment during the 30 years that had elapsed since his offense as to have effected substantial change in D.M., casting doubt on his likelihood to engage in future sexually violent predatory criminal behavior. The state dismissed the petition.
Rosenfeld said he and his client were extremely gratified by the petition's dismissal.
"It is a very rare thing to have the DA dismiss a case of this nature," said Rosenfeld. "I'm pleased our diligent efforts were able to show how much my client has changed over the last 30 years. He was facing a lifetime commitment and instead he will be going home tomorrow."
