DALLAS, Nov. 14, 2018 /PRNewswire-PRWeb/ -- UAH Property Management LP (UAH) announced today that earlier this month the Supreme Court of the State of New York, County of New York granted a preliminary injunction against former UAH owner and President Michael Clark, former UAH Vice President Lynne Clark, and their new entity Distinguished Affordable Housing Management Consultants, LLC (DAHMC). The preliminary injunction results from an ongoing legal action filed by UAH and parent company Mayfair Management Group LLC in July 2018 (Case Number 653590/2018). UAH/Mayfair is being represented by David E. Ross, Esq, a Partner with New York based law firm Meister Seelig & Fein, LLP.
Among other things, the preliminary injunction enjoins the Clarks and DAHMC from competing with UAH or Mayfair and using or disclosing any of UAH's Confidential Information. In addition, the preliminary injunction ordered that the Clarks and DAHMC were to provide "at least 10-days advance notice, by email, of any proposed contract written or oral including the proposed contract's terms" to Meister Seelig for review, and bars the Clarks and DAHMC from soliciting UAH's clients, prospective clients, vendors or employees.
UAH, which is experiencing renewed growth since the promotion of its new President earlier this year, also reported that Q3 2018 closed as one of the most successful in the company's history. "We are very pleased with this interim victory, and are pleased that the Court saw the need to provide certain interim protection to UAH/Mayfair," said Victor Salerno, Esq., a Partner and General Counsel of Mayfair. He added, "As demonstrated by our actions, we will do everything legally within our power to protect our company's interests and its employees and will continue to do so as the underlying legal action continues."
The preliminary injunction comes following information uncovered after more than 18,000 pages of discovery were provided and after a hearing, at which Mr. Clark personally testified. At that hearing, Mayfair/UAH presented evidence to support their allegations that the Defendants were competing with UAH/Mayfair and were using certain Confidential Information for that purpose.
