Bernstein Liebhard LLP Notes Filing of 400 Transvaginal Mesh Lawsuits in Scotland
New York, NY (PRWEB) March 15, 2014 -- A heated transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) litigation that now includes thousands of U.S. women has gone global, as Bernstein Liebhard notes that some 400 cases have been filed in Scotland.
According to a recent report from the Belfast Telegraph, at least 400 product liability claims have been filed in the country by women who allege chronic pain, pain during sexual intercourse and other complications stemming from inserts designed to treat such conditions as pelvic organ prolapse and stress urinary incontinence.
The news source said on March 12th, 2014 that 50 more cases accusing mesh manufacturers of failing to warn about the potential for their devices to cause patient injury are currently being investigated in the United Kingdom.* Vaginal mesh lawsuits in Scotland join thousands of claims filed in the U.S. against manufacturers C.R. Bard Inc., Boston Scientific Corp., American Medical Systems and the Johnson & Johnson subsidiary, Ethicon.
“Given the thousands of women in the U.S. who allege vaginal scarring, organ perforation and other side effects stemming from pelvic mesh, we are not surprised to see the number of claims in Europe continuing to increase," says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices including transvaginal mesh. The Firm is currently offering free and confidential case evaluations to women who may be eligible to file claims over the pelvic implants.
Transvaginal Mesh Lawsuits
In addition to hundreds of transvaginal mesh lawsuit claims in Scotland, suits are continuing to mount in federal and state jurisdictions throughout the U.S. Between several multidistrict litigations now underway in the U.S. District Court, Southern District of West Virginia, court documents show more than 40,000 case filings.
Jeffrey S. Grand, a partner at Bernstein Liebhard LLP, is an active Plaintiffs’ Steering Committee member in federal litigations that involve products from C.R. Bard Inc., Johnson & Johnson’s Ethicon unit, American Medical Systems and Boston Scientific, Corp. These proceedings include: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327).
Not unlike claims filed in the United Kingdom, plaintiffs involved in mesh lawsuit litigations in the U.S. similarly accuse these companies of designing, manufacturing and marketing products that were not only defective, but may pose danger to women.
Court documents indicate that thousands of similar actions are moving forward in two litigations underway in New Jersey’s Atlantic County Superior Court. According to a Case List updated March 7th on the court’s website, a total of 984 claims over C.R. Bard’s line of Avaulta implants have now been filed in one proceeding, while 4,762 Ethicon lawsuits involving its Gynecare implants are being coordinated in another. Mr. Grand is serving as Co-Liaison Counsel in both of these state litigations. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10; In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Women who allegedly experienced serious side effects associated with transvaginal mesh may be eligible to seek compensation from the manufacturer whose product allegedly injured them.
