Goodman Manslaughter Conviction Faces Reversal
West Palm Beach, FL (PRWEB) November 25, 2013 -- Polo baron John Goodman is asking a judge to drop DUI manslaughter charges against him, effectively reversing an earlier conviction. Goodman, who created the International Polo Club Palm Beach, was allegedly driving drunk when he caused a 2010 accident that killed Scott Patrick Wilson. He was convicted in 2012, but a county circuit judge threw out the conviction due to juror misconduct according to the Palm Beach Post (10.23.2013).
That means Goodman faces a retrial, but his legal team is asking for the case to be dropped because key evidence is no longer available.
“They asked to inspect the car he was driving the night of the crash,” said Steinger, who works to protect victims of car accidents and drunk drivers. “The prosecutors had already released it after the original conviction, so his legal team is saying they've been deprived of evidence.” (Case number: 2010CF005829AMB State of Florida vs. John Goodman)
Steinger says that tactic could work.
“Our system is supposed to give both sides a fair chance at every stage of the trial,” Steinger said. “Prosecutors should not have disposed of evidence before the appeal process was complete.”
Under his original conviction Goodman was sentenced with 16 years in prison, but Steinger says even as a free man he could still pay for the alleged crime.
