Law Office of Shane R. Kadlec Speaks Out on Accidental Child Shootings
Houston, TX (PRWEB) April 01, 2015 -- According to a CNN article on March 3, 2015, “Authorities in the Houston area are urging residents to do more to keep guns out of the hands of children in the wake of three child shootings there in four days.” Unfortunately, The Law Office of Shane R. Kadlec sees cases too often where children have been injured or even killed. For over twenty years, Attorney Shane Kadlec has been serving the area’s personal injury law needs, specializing in the representation of children in injury and accidental shooting cases. Over the years, Shane has served more than fifty times as a guardian ad litem, a representative reporting to the judge the details of a child’s injury case, in addition to his own private practice cases.
Parents need to take note of where they are sending their children every day. Not only are there school-related injuries, from sports injuries to assaults by other kids, but school is not the only place where one’s child might be poorly supervised. At neighbors’ homes, kids may find firearms, resulting in gunshot accidents. “Talk to your children about not touching guns, not even going near them. No one thinks something like this can happen to you, but no one is immune to these types of accidents. We all need to be better for each other and keep firearms away, in a locked location and always away from the ammunition,” said Attorney Kadlec.
A gunshot case near and dear to Shane’s heart was when his niece, Alyssa “Ally” Howe, who was 14 years old at the time, was accidentally shot by her best friend and at her best friend’s house. According to an article at Fox4KC article on May 17, 2012, “The shooting happened when Alyssa’s 15-year-old friend was taking a clip from her father’s nine millimeter handgun. The bullet hit Ally on the right side of her brain and lodged in the back of her head.” Although doctors originally feared Alyssa wouldn’t survive the emergency surgery that night, she is almost fully recovered. The case Amanda Howe, as Next Friend of Alyssa Howe, a minor v. Daniel Black and Derva Plude (Case No. 1216-CV27563) was heard at the Circuit Court of Jackson County, Missouri, at Independence. According to the court documents, the minor suffered injuries on or about February 10, 2012, when she was shot in the head with a gun while in the residence owned by the defendants. Although denying any liability to said minor, the defendants took into consideration the expense, delay and uncertainty of a trial, and offered a full settlement.
Attorney Kadlec continued, “God forbid something like this happens to you or a loved one; it is important to understand your rights and what actions you need to take immediately. Of course, your main priority is to get medical attention and then reach out to an experienced lawyer for a consultation. Let us do the work, while you focus on your health and getting better. From homeowner’s insurance and/or workers’ compensation to a personal injury lawsuit, there are several balls to juggle, when it comes to injuries. For example, in the event of a shooting and assuming it is an accident, homeowners insurance will pay for the damages in the majority of cases and most people don't realize this.”
