In its performance audit, the Office of State Auditor discovered concerning evidence that the CDPHE had few oversights established necessary to properly monitor physicians, caregivers, and process applications.
The Office of State Auditor found that between 2009 to 2012, the CDPHE exposed confidential patient medical information to multiple public agencies, charged unnecessarily high patient fees, mis-monitored caregivers and lacked oversight of recommending physicians. As of October 2012, twelve physicians had recommended 50% of the 108,000 patients holding valid medical marijuana cards including one physician with 8,400 patients in the registry. Between 2009 and 2012, 15 confidentiality breaches of patient medical information were discovered.
Karin McGowan, interim director of the CDPHE said that the agency tries its best to enforce laws while respecting patient and doctor confidentiality. “Sometimes it feels like we’re between the dog and the fire hydrant on this issue,” McGowan said.
In response to its findings the Office of State Auditor has recommended numerous areas that the CDPHE must improve upon if it wishes maintain a Federally compliant State Medical Marijuana Program. This includes an update to its technology, a comprehensive strategic plan and an improvement in its oversight of physicians recommending medical marijuana, among others. Fortunately for the Colorado Medical Marijuana patients, the CDPHE generally agreed with the Office of State Auditor recommendations.
