Maryland Workers' Compensation Lawyers Obtain $395,000 Award
Columbia, Maryland (PRWEB) March 24, 2015 -- Through intense preparation, aggressive representation, and thorough investigation of documents, the highly experienced Portner & Shure attorney, Kevin Ruby, and Senior Claims Paralegal, Pam Brown, were able to assist their client in obtaining a $395,829 award for the client as handed out by the Maryland Workers' Compensation Commission (WCC Claim No. B790291).
As WCC documents show, this case arose almost two years ago, on a rainy day, when the decedent stepped out of his car at his place of employment and put his hood on to avoid getting wet. As the facts of this case also show, he was sadly run over and killed by a co-worker in the parking lot.
Mr. Ruby and Ms. Brown worked in order to help our client’s spouse recover compensation in a Maryland workers’ compensation dependency claim case. WCC documents also revealed that the decedent’s wife was not working at the time of the accident and was solely dependent on her husband’s income.
The damages awarded in this case were very complicated because there was the award determined by the Workers’ Compensation Commission (WCC) and a wrongful death claim arising from the co-worker running the decedent over with his car. The WCC required a hearing to determine whether decedent’s wife was dependent on his income by hearing testimony from her and examining the couple’s financial records. Ultimately, the WCC determined and ruled that she was a dependent and awarded a weekly payment of $721 over a 144-month period to decedent’s spouse based on the decedent’s income before death. As the WCC ruling shows, there is one caveat to the award: the decedent's spouse is only entitled to these payments up until what would have been the decedent’s 70th birthday, which is eleven years from now, or 127 months.
Mr. Ruby commented after receiving a favorable award from the Maryland WCC, "Our record of obtaining large settlements and awards is further proof of Portner & Shure's dedication and commitment to our number-one priority--our clients."
