Agoura Hills, CA (PRWEB) October 21, 2014 -- According to court documents for case number BC509053, Los Angeles Superior court, iPayment brought four causes of action against Prudential’s CEO Aaron Nasseh, claiming defamation and related causes of action, arising from an email Nasseh had sent to certain independent sales agents. Counsel for Nasseh responded with an anti-SLAPP motion against iPayment. The motion by Nasseh and Prudential allege that statements made by Nasseh were true and that iPayment has filed a Strategic law suit against public participation (SLAPP), against Nasseh’s right of public participation in violation of CCP 425.16(e). It also alleges that iPayment brought this action for the sole purpose of chilling the valid exercise of free speech, and in a misguided attempt to gain leverage in this action.
When a defendant brings an anti-SLAPP motion, the plaintiff is then required to show that it is more likely than not to prevail on its claims. Instead of making any effort to show the merits of its claims, iPayment elected not to oppose the motion, and simply dismissed all four causes of action.
